1. Acceptance of Terms
By downloading, installing, or using the "Tap Color Quickly" mobile application (the "Game"), developed by Dynamik Wizard ("we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to any of these Terms, you must immediately stop using the Game and uninstall the application.
These Terms constitute a legally binding agreement between you and us. It is your responsibility to review them periodically, as we may update them at any time. Updates will be posted on this page and take effect immediately. Your continued use of the Game after any changes constitutes acceptance of the revised Terms.
2. Eligibility
The Game is intended only for users aged 13 and older. While the content of the Game is generally appropriate for a wide audience, it includes advertisements provided by Google AdMob, which may not be suitable for younger users. By using the Game, you confirm that you are at least 13 years old. If you are under the age of 13, you must not use this application.
3. Description of the Service
The Game provides interactive entertainment via mobile platforms. Access to the Game is free, but it may include in-app purchases and display advertisements through Google AdMob. We reserve the right to modify, suspend, or discontinue access to any part of the Game at any time, with or without notice.
4. Intellectual Property
All rights to the Game, including intellectual property rights in its content, graphics, sounds, software, and other materials, are owned by Dynamik Wizard unless otherwise stated. Protected rights include but are not limited to copyrights, trademarks, trade secrets, patents, and design rights. You may not copy, distribute, transmit, reproduce, publish, license, modify, translate, or create derivative works from any content in the Game without our prior written permission. Use of the Game does not grant you ownership of any content.
5. Advertising and Third-Party Services (Google AdMob)
The Game uses Google AdMob to display both personalized and non-personalized ads. AdMob is a Google service that uses cookies and other technologies to collect information about your usage habits to show relevant ads. By accepting these Terms, you agree to the collection and use of your data according to Google's Privacy Policy (https://policies.google.com/privacy). We do not control the content of the ads shown and are not responsible for the products, services, or offers advertised. Any relationship or transaction you enter into with an advertiser is solely between you and the third party.
6. Privacy Policy and Data Collection
We respect your privacy. When using the Game, we may collect and process certain personal data such as your IP address, device information, geographic location, and in-game behavior. This data is collected to improve the Game's performance, personalize your user experience, and optimize ad delivery via AdMob.
7. In-App Purchases
The Game may offer in-app purchases for products or services. All purchases are processed through Google Play and are subject to Google’s terms and conditions. We are not responsible for transaction errors or refunds. All billing-related inquiries must be directed to Google Play. By making an in-app purchase, you are granted a limited, personal, non-transferable license to use the purchased items within the Game. These purchases do not grant ownership of the virtual goods and are non-refundable except as required by applicable law.
8. Restrictions on Use and Prohibited Conduct
You agree not to:
- Decompile, disassemble, reverse engineer, or otherwise attempt to derive the Game’s source code.
- Use the Game for any illegal or unauthorized purpose.
- Interfere with the Game’s operation or security features.
- Use automated tools (such as bots or scripts) to access the Game.
We reserve the right to suspend or terminate your access to the Game if you violate these rules or engage in conduct we deem inappropriate.
9. Limitation of Liability
The Game is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not guarantee that the Game will be error-free or uninterrupted. Under no circumstances shall we be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Game, including but not limited to loss of data, revenue, or profits.
10. Indemnification
You agree to indemnify, defend, and hold harmless Dynamik Wizard, its employees, contractors, agents, and partners from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your use of the Game, your violation of these Terms, or your violation of any third-party rights.
11. Termination
We reserve the right to suspend or terminate your access to the Game at any time and for any reason, with or without notice. Upon termination, your rights under these Terms will cease, and you must immediately stop using the Game.
